Apex court to hear Sahara City issue next week

{image-supreme court_20062008.jpg news.oneindia.in}New Delhi, Jun 20: The Supreme Court will hear next week the petition filed by Uttar Pradesh government against Allahabad High Court order directing it to restore the boundary wall of Sahara Shehar in Gomti Nagar, Lucknow.

The vacation bench comprising Justices Arijit Pasayat and G S Singhvi directed the listing of matter next week when it was mentioned before the bench by counsel for UP government for urgent hearing. The Lucknow bench of Allahabad High Court had pulled up Mayawati government for carrying out the demolition of the wall and directed it to restore the same and restraining it from carrying out further demolition. UP government has come in appeal to the Supreme Court against that order.

Contention of the state government is that land is required for constructing a road and the state government can remove the encroachment without any notice.

The petition in the High Court was filed by Sahara India Commercial Corporation limited which is building Sahara city in Gomti Nagar.

Counsel for the UP government mentioned the petition before the Supreme Court today and wanted it to be heard on June 23.

The apex court said the court will hear the petition next week but not on Monday.

High Court also held that Sahara has the right to construct boundary wall to protect its property.

The UP government was directed to file its response within three weeks.
