Delhi HC seeks ATR against illegal 4th and 5th floors
New Delhi, Apr 8 (UNI) Delhi High Court today issued notices to the MCD, DDA, NDMC, PWD, CPWD and L&DO for delaying the compliance of its order regarding the demolition of illegal 4th and 5th floors in the capital.
A Division Bench comprising Justice A K Sikri and Justice Rekha Sharma, taking note of the court-appointed monitoring committee's report, asked the MCD and others why no action has been taken against the illegal floors built in the city.
Earlier, on November 16, 2007, the Court had directed the monitering committee to convene a meeting with all civic agencies and court commissioners and devise methods to identify those properties in Delhi which are not covered by the two ordinances and Master Plan of Delhi-- MPD 2021.
The High Court had directed that the properties not enjoying the protection of law including 4th and 5th floors of residential plots should be identified and either demolished or sealed.
The moniteering committee informed the court today that the MCD has neither submitted any list of the properties which it has regularised so far nor has it submitted any action taken report (ATR) to them. Similarly, the DDA has also not submitted any report to them, it said.
The court directed the MCD, DDA and other civic authorities to comply with their orders and submit the ATR in the court by April 29.
