HC directs CBI Special Judge to return passport
Chennai, Apr 1 (UNI) The Madras High Court today directed the Additional Special Judge for CBI cases, Chennai to return the passport to former CB-CID DIG A P Mohammed Ali, who is facing trial in the multicrore fake stamp paper scam.
Mr Justice M Jeyapaul, admitting a writ petition by Mr Ali, allowed him to travel to United States of America for a period of 60-days.
In his petition, Mr Mohammed Ali said he was appearing before the CBI court, which was trying the case for the past two years without seeking any exemption. His daughter was staying along with her husband and two kids in USA and he received a letter from her stating that she was expecting to be delivered of a third child in the month of May 2008. He wanted to go to USA with his wife. The petitioner also gave an undertaking to the court that he would return to Chennai after spending sometime with her daughter.
While ordering the CBI to return the passport, the Judge said there is no matterial to back a mere bald allegation of the prosecution that the accused may not return, if he is permitted to go abroad.
