RJD MP challenges decision to conduct trial against him in jail

New Delhi, Mar 10 (UNI) The Supreme Court today issued notices to the state of Bihar on a petition filed by RJD MP from Siwan constituency Mohammed Shahabuddin challenging the decision of the state government to conduct trial against him in jail.

A bench comprising Justices Ashok Bhan and Dalveer Bhandari issued notices after hearing counsel for the petitioner who contended that as per the provisions of CrPC place of trial can be changed only with mutual consent of the state and the defence.

The RJD MP, who is facing several criminal cases and is presently serving life imprisonment in a murder case, is being tried in jail as according to the prosecution witnesses cannot depose freely against him in view of his terror on the area.

The RJD leader had come in appeal to the Supreme Court against the Patna High Court judgement dismissing his petition challenging the decision of the government to try him in jail.

Nitish Kumar government had changed the venue of the trial from court to jail.
