Info on transfer, posting in public authority not personal:CIC

New Delhi, Feb 11 (UNI) The information concerning transfer and posting in a public authority is information regarding a public activity and cannot be denied on the ground of being personal, the Central Information Commission has ruled.

''Such an information cannot be witheld under Section 8 (1) (j) of the Right to Information Act (RTI), it said allowing the appeal of one Mr Achchhey Lal of NOIDA, Uttar Pradesh who had sought information about the status of the transfer application of his son working with the Nuclear Power Corporation of India.

The CPIO of the Corporation had contended that information sought was with regard to a third party and was therefore deemed personal. Mr Achchhey Lal, on the other hand, had said the reply given by the authorities without application of mind, as the third party in question was his own son.

The CIC said, ''At best the information sought could be considered third party even though Mr Surinder Singh is, in fact, the son of Mr Achchhey Lal. But for information to come under mischief of Sec 11(1), it has to be treated as confidential by that third party. To assuage any doubt, it was open to the CPIO to determine the views on disclosure to Mr Achchhey Lal from Mr Surinder.'' It asked the Corporation officials to provide point-wise information on the questions asked by appellant through his application of 2-11-06 within one week of the issue of this decision notice. The CIC ruling was given on February 1.
