HC to hear Uphaar victims' plea on Jan10

New Delhi, Jan 10:: The Uphaar victims under the banner “Association of Victims of Uphaar Tragedy" (AVUT) have moved the Delhi High Court seeking enhancement of the two years" rigorous imprisonment sentence to cinema hall owners Sushil Ansal and Gopal Ansal and three others. The matter is come up for hearing today.

The Association has filed the petition under Section 304 (culpable homicide not amounting to murder) of the Indian Penal Code (IPC) which provides for life imprisonment or 10 years imprisonment and fine. The Association said that at the time of reading of the trial court judgement in the case in last November, the evidence produced had fully indicated that the convicts had the proper knowledge that their acts were likely to cause death of the people visiting the cinema hall. So the ingredients of the offence come under Section 304.

As many as 59 cinemagoers had died in the massive fire at Uphaar cinema on June 13, 1997.
