4th, 5th flr demolition can't be stopped without raising FAR:Arya
New Delhi, Jan 9 (UNI) Leader of the House in the MCD Subhash Arya today said that it was impossible to stop demolition of fourth and fifth floors beyond a height of 15 m as per the orders of the court unless FAR was increased by the central Government.
Refuting the statement given by Union Minister of State for Urban Development Ajay Maken yesterday that there would be no demolition of fourth and fifth floors within a height of 15 m, Mr Arya, addressing newspersons here, said the statement was misleading, meant to create confusion among the people of Delhi.
Mr Arya said as per the new building bye laws, at plots upto an area of 175 sq m, 4th floor upto height of 15m with 350 FAR is allowed.
''In case, the FAR is not increased, the fourth and fifth floors of these residential houses constructed prior to December 31, 2006 with 100 per cent coverage will have to be demolished since the house owners have covered 100 per cent area at ground and first floors.
Hence, to save such houses from demolition, it is imperative that the limit of 350 FAR in the new building bye-laws be removed and all residential floors constructed prior to December 31, 2006 be regularised by a one time amnesty scheme. Then and only then the house owners who constructed their houses through their hard earned money can be saved from demolition,''Mr Arya said.
He said in the 2021 Delhi Master Plan, the sub division of industrial plots have been allowed.
''If this provision is allowed in residential areas under new building bye-laws, then the houses which were subdivided after partition in a joint family can also be saved. If this will be implemented, then the sub divided plots sold by any family member after partition could also be regularised,''he said.
The MCD leader of the House said he had asked the Union Urban Development Minister to give him time for a meeting where Mr Arya said he would urge the minister that the required amendements be made in the building bye laws and a general amnesty scheme be implemented to save from demolition those houses constructed prior to December 31, 2006.
He demanded that if need be an Ordinance in this regard be promulgated to provide relief to anxious citizens of Delhi.
