SC not to interfere in spectrum allocation

New Delhi, Jan 8: The Supreme Court today refused to intervene on the issue of spectrum allocation. Social Action Forum for Manav Adhikar, an NGO, had filed a petition in the apex court seeking its intervention.

The NGO is demanding the allocation be done through auction in place of first-cum-first serve basis. Bench headed by Chief Justice K G Balakrishnan said the government couldn't be prevented from taking a policy decision. Let them (government) take a decision and you can challenge it." Chief Justice Balakrishnan said. "The government is in the best position to decide who is the best bidder. The Judiciary cannot decide this," he added.
The Bench further said that the petitioner has not mentioned for whom the favour has been done.

On this issue, senior advocate P H Parekh said that he would further amend the petition and would come out with detailed facts. The court adjourned the matter thereafter.
