Puri, Nov 8 (UNI) Puri Additional District Magistrate S N Panigrahi has filed a complaint case against sitting Biju Janata Dal(BJD) Legislator Pradip Maharathy for suppressing facts in the mandatory affidavit filled during the nomination papers for 2004 Assembly polls.

The case was filed yesterday by Mr Panigrahi, the then Returning Officer for the Pipli Assembly constituency following a complaint case, lodged by Mr Maharathi's rival Judhistir Samantray of the Congress with the returning officer and the state Election Commission.

In his complaint, Mr Samantray alleged that Mr Maharathy was an accused in a GR case under the Nimapara court and the case was pending at the time of filling of papers. The case was, however, not reflected in the affidavit of the BJD MLA during the filing of the nomination papers.

The Commission had instructed the Returning officer to initiate a complaint case in the court of the sub-divisional judicial magistrate against Maharathy as per the election rules.
