HC dismisses writ over nuke deal

New Delhi, Aug 30 (UNI) The Delhi High Court today dismissed a writ petition seeking directions to the Government to approach the Supreme Court through the President regarding the validity of 123 Agreement with the US, if India conducts fresh nuclear test.

A bench comprising Chief justice M K Sharma and Justice Sanjiv Khanna said they have no jurisdiction to direct the President to call for any proposals. However, it said that the petitioner may approach the apex court.

Lawyers Sugriva Dubey and Namita Roy had approached the High Court aggreived by the ongoing tussle between the government and its allies on the issue of Nuclear Deal.

Mr Dubey had argued that since the Agreement was a legal document the Court should intervene and ask the government to clarify its stand specially over sections which reportedly stated that the US can terminate the deal in the event of India conducting fresh nuclear test.

Also, he had sought the government to come clean over uninterrupted supply of nuclear fuel and right to reprocess the spent fuel.
