HC orders arrest of Investigation Officer

Allahabad, Aug 29 (UNI) A division bench of the Allahabad High Court today passed an order for the arrest of Investigation Officer (IO) and his production in the court tomorrow morning for non- appearance in the court despite High Court's order.

The IO is investigating a case lodged against Mohd Abbas, one of the alleged associates of Samajwadi Party MP Atiq Ahmad at Kareli police station, Allahabad for eliminating a canal, pre-existed to the sale deed executed in favour of petitioner and others for the construction of ''Mak Town.'' A Bench, comrising Justices K S Rakhra S K Jain, directed the IO should be presented at 10 am in the court tomorrow. Besides ordering to put him under suspension for deliberate flouting of the courts order.

The allegation against the IO was that he inspite of an interim order in favour of petitioner by the HC had obtained an order under section-82 of the Cr PC for attachment of the petitioners property.

The counsel appearing for the petitioner, S M A Kazmi assisted by Shariq Ahmad contended in the court that the IO's non-appearance in the court, despite HC order on ex-facie, was contempt of court.

They pointed out the court that nine days were utilized by the police to frame three more cases against the petitioner, but the IO did not appear in the court nor filed any affidavit.

The FIR against the petitioner and other co-accused namely Khalid Azim alias Ashraf, former SP MLA and others were lodged at Kareli police station for eliminating a canal.
