Shahabuddin's bail petition rejected
Patna, Aug 18 (UNI) Patna High Court today rejected the regular bail petition of incarcerated RJD MP Mohammad Shahabuddin in connection with recovery of foreign made pistol and its cartridges from his residence at Pratappur in Siwan district.
Justice V N Sinha rejected the bail petition of the RJD MP after hearing the arguments of both petitioner and the prosecution.
The counsel of Mohd Shahabuddin submitted before the court that the RJD MP was lodged in Siwan jail on November 7, 2005 and he had already been in the prison for a considerable period of time, keeping in view of the maximum punishment of three years of jail term, awarded to an accused if found guilty under Arms Act.
While opposing the plea of the pertitioner, the state counsel contended that of the eight witnesses in the case, three had been produced in the concerned court, while the rest would be produced within three months.
The counsel submitted before the court that bail should not be granted to the accused at this stage.
Mohd Shahabuddin had filed the petition seeking bail in connection with the case, earlier this year.
