Petition challenging special court's constitution dismissed

Patna, Aug 14 (UNI) Patna High Court today dismissed the petition of RJD MP Mohammad Shahabuddin challenging the constitution of special courts inside the Siwan jail premises for speedy trial of the cases pending against him.

A single bench of Justice Shyam Kishore Sharma pronounced his judgement after hearing the arguments of both the prosecution and the petitioner. In the ruling, the judge observed that special courts were constituted under the provision of law and the petition has no merit.

The counsel of Mohammad Shahabuddin submitted before the bench that special courts were constituted in contravention with the provision in law. The counsel also stated that the special courts constituted in this connection were 'biased'.

But state counsel opposing the arguments of the petitioner, said that the special courts were constituted in accordance with the law as stipulated in criminal procedure code.

The special courts were also constituted in consultation with High Court as warranted under the provision of law.
