HC asks UP govt to file affidavit

Allahabad, Aug 2 (UNI) Allahabad High Court has directed the Uttar Pradesh government to file an affidavit, as to whether in each district of the state, any doctor is working and posted for more than 10 years, either on a regular posting or on zero posting.

A division bench comprising Justices V M Sahai and Bharati Sapru passed this order on a writ petition filed by Dr Ashok Kumar, who had challenged his transfer.

The UP principal secretary, medical health and family welfare department has been directed to file an affidavit to the affect.

Passing this order, the court left it open to the principal secretary to transfer all doctors, without any exception, who had completed 10 yrs service either in regular posting or on zero posting in compliance of an order passed by this court in Virendra Pal case.

The judges, however, clarified those doctors, who had completed 10 years of service in a district, but are due to retire by September 2008 shall not be transferred.

The next hearing in the case will take place on Monday.
