Court grants interim relief to ex-DCP Kapse till July 27

Mumbai, July 20 (UNI) The City Civil and Sessions Court Principal Judge Ashok Bhangale today granted interim relief till July 27 to former DCP Dr S R Kapse in a case of misappropriation in police Housing scheme.

A complaint filled by a constable at Pant Nagar Police station, Ghatkopar, allegedly stated that Dr Kapse and others were involved in misppopriation of Police Housing Scheme fund. Fearing their arrests, they had filed Anticipatory Bail Application.

While passing an order on Anticipatory bail application filed by Dr Kapse and others, Judge Bhangale granted stay on their arrest till July 27 and directed them to surrender before Metropolitan Magistrate court at Vikhroli on or before that date.

Opposing Anticipatory Bail Application, additional Public Prosecutor Geeta Waiude said the applicant had collected more than Rs 10 crore from police personnel in late 90s to construct housing flats for them at Shanti Nagar, Ramabai Ambedkar Nagar, Ghatkopar.

But, the applicant and others had failed to build flats for police personnels since then.

Ms Waiude said the land was provided by government at free of cost and only construction cost was to be paid for one-room-kitchen flats.

She said there was a proposal to construct more than 480 flats.

But till date 348 police personnels have neither received possession of the flat nor their hard earned money was returned.

Earlier, defence advocate Girish Kulkarni argued that it was a phase-wise work, two phases have already been completed and third phase was likely to be completed by end of this year. His client was ready to pay back the money of the complainant, if he did not want a flat, Mr Kulkarni said.
