HC allows petition against narco analysis test

Bangalore, July 17 (UNI) The Karnataka High Court today allowed a criminal petition from an accused in an legislator's assault case challenging a lower court order allowing the authorities to take custody and conduct a narco analysis test on him.

Mr Justice K Ramanna allowed the petition filed by Y Jagadish Chidanand Kore, an accused and chargesheeted under the IPC and the Arms Act for allegedly injuring sitting MLC Prabhakar Kore at Ankalgi on October 19 last year.

Kore challenged the order of the II Additional Sessions Judge, Belgaum allowing the application of the state government seeking permission for taking custody and conducting narco analysis test on him.

The court also took on record the submission made by the State Public Prosecutor saying the state was not interested in securing the custody of the petitioner for subjecting him to narco analysis tests in view of the heavy rush in the laboratory and the long dates given for the testing.

Earlier, the application filed by the Investigating Officer seeking police custody of the petitioner had been rejected by the JMFC, Chikodi by a order on February 8 this year against which the state successfully filed the application before the Additional Sessions Judge, Belgaum.
