Nagpur, June 27 (UNI) A petition filed by Devi Singh Shekhawat, husband of UPA Presidential candidate Pratibha Patil, before the High Court here seeking dismissal of criminal proceedings against him on charges of abetment to suicide, is scheduled to come up for a hearing tomorrow.

The single bench of Justice A P Lavande at the Nagpur Bench of the Bombay High Court has already issued a notice before the admission in response to the petition.

The case pertains to the alleged suicide by one Kisan Dhage, who was a teacher in one of the schools of Vidya Bharati Shikshan Prasarak Mandal run by Mr Shekhawat. Dhage ended his life by consuming poison at his native village Songaon in Jalgaon-Jamod tehsil in Buldhana district of Vidarbha region on November 15, 1998.

He had left behind a suicide note in which he alleged harassment by Mr Shekhawat and three ''others''.

On July 25, 2000, Dhage's wife Mangala approached the Judicial Magistrate First Class (JMFC) at Jalgaon-Jamod with a private criminal complaint alleging that the police had not registered an offence in connection with her husband's suicide. The JMFC then issued orders to the police to initiate criminal proceedings in the case.

Mr Shekhawat initially approached the High Court here against the JMFC's ruling. However, he later withdrew and filed a revision petition before JMFC Jalgaon-Jamod seeking to get the criminal proceedings against him quashed. The revision petition was dismissed by the JMFC and Mr Shekhawat then approached the High Court against the order.

Issuing a notice on April 11, Mr Justice Lavande also stayed proceedings against Mr Shekhawat and three others which was initiated in the trial court.

Mangala, meanwhile, filed a separate civil case before the court in Jalgaon-Jamod seeking compensation for her husband's death. The case is still pending.
