Tower exempted from being demolished

New Delhi, June 21 (UNI) The Delhi High Court has directed the Municipal Corporation of Delhi (MCD) not to take any cohesive action against a communication tower built on the rooftop of a building at Dakshin Puri in North Delhi which has been sealed by the corporation.

Justice Pradeep Nandrajog yesterday refrained the MCD or any other person to remove the tower as it falls under the category of services which have been exempted by the Supreme Court monitoring committee from sealing.

Counsel for the tower owner Sanjay Jain told the court that the tower was installed on the building in 2004. The building was sealed by the MCD in 2005. Since the building was sealed after an year of its installation, the tower was exempted from sealing or closing down as per the directions of Supreme court monitoring committee.

The committee had exempted certain buisiness premises like Communication Tower, optical shops, among others, from sealing.

The MCD, while de-sealing the premises laid down the condition to the owner of the building to remove the tower, forcing the tower owner to approach the court to seek an injunction order.
