SC dismisses petition challenging Mayawati as CM
New Delhi, June 13: The SC today dismissed a petition challenging the appointment of BSP president Mayawati as the Chief Minister of Uttar Pradesh.
A vacation bench, comprising Justices Arijit Pasayat and P P Naolekar, dismissed the petition, holding that in view of an earlier judgement of the court, there was no merit in the petition and it was accordingly dismissed.
An advocate, Ashok Pandey, had filed the petition challenging the appointment of Ms Mayawati as the Chief Minister and Mr Satish Chandra Mishra as a cabinet minister in UP on the ground that both were Members of the Rajya Sabha and as such their continuance in the state government without resigning their parliament seats was unconstitutional and illegal.
Mr Pandey had also sought directions from the apex court to quash all the decisions taken by the Mayawati government since she took over the reins of Uttar Pradesh in May.
The court said it would give reasons for the dismissal of the petition later. Counsel for Ms Mayawati had, however, contended that the petition was frivolous and politically motivated and deserved to be dismissed with cost.
The counsel had contended that earlier also, the apex court had imposed a cost on Mr Pandey for filing such a petition.
Ms Mayawati did not contest the Assembly election and will have to seek by-election to the Assembly or the Council within six months.
Ms Mayawati and Mr Mishra have not resigned their Rajya Sabha seatstill date.
