SC to decide fate of Maya, colleague on Jun 13
New Delhi, June 12: The Supreme Court will give its judgment on June 13 on a petition challenging the appointment of Ms Mayawati as Uttar Pradesh Chief Minister and that of Mr Satish Chandra Mishra as Cabinet minister in the state.
The verdict will be delivered by a vacation bench comprising Justices Arijit Pasayat and PP Naolekar.
The appointments of Ms Mayawati and Mr Mishra have been challenged by an advocate, Mr Ashok Pandey, on the ground that both are Members of Rajya Sabha and as such their continuance in the UP government without resigning their parliament seat is unconstitutional and illegal.
The apex court had reserved the judgement on June 11 after the arguments on the petition was concluded.
The petitioner has also requested the court to quash all the decisions taken by Mayawati government with effect from May 13, 2007 when she took over as CM of Uttar Pradesh.
Both of them have not resigned their Rajya Sabha seats till date and as such it was unjustified on the part of UP Governor to have administered the oath of office to Ms Mayawati and her cabinet colleague, Mr Satish Chandra Mishra on May 12, this year.
Mayawati is not a member of UP assembly and as such has to win an election within six months to continue as CM of the state.
