New Delhi, June 7: The BJP today clarified that the FIR against Gujjar leader Col Kirori Singh Bainsla in the murder and criminal conspiracy case in Rajasthan was filed the same day and not after the talks with Gujjar community or the Supreme Court rap.

Party spokesman Prakash Javadekar said it was a common practice to register the case dealing with violence in mass agitations in the name of unidentified attackers and their leaders who have given the call for the agitation. The cases will continue on only those who were present and involved in the attacks during the investigation stage. ''In this case Lt Col Bainsla was sitting in dharna at some place and the murderous incident took place somewhere else.'' He said the FIR was filed on the same day, May 29, while the talks between the Gujjar leaders and the Rajasthan Government took place on June 4 and the observation by the Supreme Court was made on June 5. This being the case, it would be improper to say that the FIR was filed after these two events but on the same day as the incident happened, he asserted. Mr Javadekar also said that he was clarifying the chronology of events to obviate any misunderstanding.

He denied reports that one Rajasthan minister belonging to Meena community had instigated his fellow castemen to attack Gujjars to prevent their entry into Scheduled Tribe list. The minister had left Jaipur but his helicopter could not land at the intended place because of lack of coordination.

Such being the case it was not proper to accuse him of instigation when the fact was that his copter did not even touch the ground where the Meenas and Gujjars attacked each other, the spokesman said.

Asked if the BJP expected peace to prevail in Rajasthan after three months when the panel headed by a Judge is expected to submit its report on the demand of Gujjar community, he said the BJP wanted to dispense justice to all communities and take everyone along.
