HC grants time to vacate Resort in Munnar
Kochi, June 1 (UNI) A division bench of the Kerala High Court today granted time to the Cloud-9 Resort in Munnar to vacate the building on 1700 hrs tomorrow.
A bench comprising Chief Justice H L Dattu and Justice K T Sankaran granted the time while hearing an appeal filed by the Resort.
In the morning Justice S Siri Jagan had dismissed the petition stating that it could approach the Land Revenue Commission for a stay on demolition of the resort.
The petitioner approached the Court challenging the order of the Idukki District Collector, who cancelled the Title Deed of the land, where the Resort was constructed.
The counsel for the State submitted that the petitioner had already approached the civil court for declaration of their title on the land and also filed a petition for injunction.
The Court recorded the submission and directed the petitioner to approach the Land Revenue Commission by filing an appeal.
Against the order of the single judge, the petitioner filed an appeal before the division bench in the afternoon.
The Court, after hearing the petitioner and the government pleader, opined that the petitioner could not seek parallel proceedings by filing civil suit and petition to the High Court for the same remedy.
