HC directs resort owner to file statutory appeal

Kochi, May 31 (UNI) Kerala High Court today directed a resort owner to file statutory appeal before the Land Revenue Commissioner against the order cancelling the title deed of his property at Munnar hill station.

Justice S Siri Jagan directed the Commissioner to dispose off the appeal by petitioner Ramaprasad who owned the resorts 'Shanyasree Yahtri Niwas' before Wednesday next. The court also made it clear that all further proceedings persuant to the notice issued to the resort would be kept in abeyance till then.

The court gave the direction while disposing off a petition filed by one Dhanya. The petitioner contended that they constructed the resorts on a land fow which there was a valid patta. The conunsel for the state D Anil Kumar contended that the patta was issued by Deputy Tahsildar who was no authority to issue the same. Therfore, the patta itslef was not valid.

The court also directed the petitioner to move a petition before the land revenue commissioner seeking a stay.

Meanwhile, another writ petition was filed by the brother of IG Tomin J.Thachenkerry, Nisn Thachenkerry, who is the managing director of Thachenkerry estates and resorts.

The petition challenged the steps taken by the authorities to demolish the tourist resort and its compound wall.

Another writ petiton filed by the Autumn Wood resorts who owned the resort '' Cloud 9'' at Munnar. The petitioner challenged the decision taken by the district collector who cancelled the patta even without notice to the petitioner.
