HC dismisses petition in Noida land scam

Allahabad, May 28 (UNI) The Allahabad High Court today dismissed a petition, filed by the managing director of Flex Industries Ltd Ashok Chaturvedi in the Noida Land allotment scam case.

Mr Chaturvedi, along with former UP chief secretary and then chairman of Noida Neera Yadav, is facing trial in the case in the court of Special CBI Judge, Ghaziabad under the Prevention of Corruption Act.

The applicant, Ashok Chaturvedi, had filed an application in the Allahabad High Court under section 482 of CrPC, praying to set aside an order of May 21, 2007 passed by the CBI court, Ghaziabad, whereby application for exemption from personal appearance was rejected.

Dismissing the application of the managing director of Flex industries, Justice Ravindra Singh said since the matter pertaining to the criminal case in Noida land allotment matter is pending in the Supreme Court, therefore, the applicant can move application before the apex court.

The CBI had submitted chargesheet against the applicant and Mrs Yadav for reducing the rate of land allotted to applicant, causing monetary loss to the authority.

The Special CBI judge had taken cognizance and summoned the applicant and other accused in May 21, 2002.

The offence is punishable under section 120-b of IPC read with section 13 (1) with section 13 (1) (d) of the Prevention of Corruption Act.
