Additional Sessions Court Judge P M Jethani said there was no substantial evidence against accused Mohammed Jani Shaikh and that the deceased had, in her dying declaration, stated she had consumed 'rat poison' by mistake, therefore acquitted him of all charges.

In her dying declaration on September 9, 2000 she had that she consumed rat poison instead of the liquid medicine that the given by the doctor to treat her cough and cold, as there was a power cut at that time.
