HC directs ECI to file counter on petition against Jaya

Chennai, Apr 17 (UNI) The Madras High Court today directed the Election Commission of India (ECI) to file its counter to the petition, seeking prosecution of former Tamil Nadu Chief Minister J Jayalalithaa for allegedly filing nomination papers in four constituencies during the 2001 Assembly election and making false declaration before the Returning Officers of Bhuvanagiri and Pudukkotai.

A division bench comprising Mr Justice Dharmarao Elipie and Mr Justice S Palanivelu gave the above directive while posting to April 24, further hearing on the petition filed by DMK MP C Kuppusamy.

In his petition, Kuppusamy submitted that in the 2001 Assembly election, Ms Jayalalithaa had proposed to contest as a candidate and filed her nomination papers in four assembly constituencies, Andipatti, Dharmapuri, Bhuvanagiri and Pudukkotai in contravention of Section 33 (7) (b) of the Representation of the People Act (RPA).
