HC restrains certain schools from admitting new students

Chennai, Apr 11 (UNI) Madras High Court today restrained certain Central Board of Secondary Education (CBSE) schools from admitting new students to Class XI, without admitting students of Class X of the same school, in the group of their choice subject to sanctioned strength.

A Division Bench comprising Chief Justice A P Shah and Mr Justice D Murugesan granted the interim injunction while ordering notice, returnable by April 18, to Union Ministry of Human Resources Development, Secretary CBSE and Joint Secretary, CBSE-Southern Region, on a petition filed by Concerned Citizens's Committee Chennai Convenor S Anandalakshmy seeking a direction to ensure that all students of Class X in a school affiliated to the CBSE were admitted to Class XI in their own school to the subject groups of their choice.

In her petition, Dr Anandalakshmy submitted that the committee was formed in January 2007 when reports appeared about emotional stress and trauma experienced by students. Provisional admissions are given even before the standard X board examinations are written by the students.

The procedure adopted by some CBSE schools in Chennai rejecting continuation of admission to standard XI to their own students, based on arbitrarily decided cut off marks was an irregular procedure, she submitted.

Such a practice has come about owing to unhealthy competition among different schools to claim themselves to be the best school as they produce the maximum toppers in the standard XII board examination, she submitted.

She said the continuation of such procedure was both unhealthy from view point of the students emotional and psychological well being. Such a practice had also been declared to be bad in law by the Supreme Court in the case of Principal, Cambridge School Vs Payal Gupta (1995). It was held that any school denying admission to its own class X students to class XI was illegal and once the student was given admission in any educational institutions he or she should continue in the same school class after class, until the student leaves the school, she submitted.
