HC clears Kamal's new film for exhibition

Chennai, Apr 10 (UNI) Madras High Court today dismissed a petition, seeking to restrain Oscar Films from exhibiting the Tamil film 'Dasavatharam', starring popular filmstar Kamal Hasan, for public viewing.

Justice V Ramasubramaniam dismissed the petition filed by one Senthil Kumar, seeking to restrain Kamal Hasan and Oscar Films from releasing the film as it was a reproduction of his story.

The judge also vacated the stay granted earlier on January 20, 2007.

In his order, the judge said the applicant had come to court on a total misapprehension that his story had been copied. He had no proof to show that his story had been copied.

Even though the applicant did not produce any proof to show that the story adopted by Kamal Hasan and Oscar Film was a replication of his story, this Court granted the indulgence of compelling the defendants to disclose their storyline, with a view to do justice to the applicant, the judge observed.

He said the disclosures made by the defendants about the storyline had cleared any suspicion of plagiarism.

The Judge said ''I have read the storyline adopted by both the parties. A reading of the same would give an unmistakable impression that there was no commonality at all. With the result, petition was dismissed and the interim order of injunction originally granted on January 20, 2007 was vacated'', he added.
