Disaffiliation of engineering college stayed

Bangalore, Mar 29 (UNI) The Karnataka High Court today stayed the order of the Visweswaraiah Technololgical University, disaffiliating the Engineering College of Bijapur due to lack of infrastructure and faculty, until further orders on certain conditions.

Chief Justice Cyriac Joseph and Mr Justice B S Patil granted the interim injunction on a writ appeal, filed by the said college challenging the interim order passed by Mr Justice Ramamohana Reddy, refusing to grant stay and permitting the University to proceed with realloting students of the disaffiliated colleges in other colleges.

The Bench directed that if any of the students presently studying in the appellant college decided to join the college in which he/she was offered admission in the counselling dated March 25, 2007, the appellant college should not prevent them, but give certificates, including the Transfer Certificate, to them on demand.

It was further directed that the students who wished to continue their studies should be allowed to continue and appear for exams as per the rules. The appellant college was directed to take necessary steps for rectifying the deficiencies pointed out by the report of the Local Inquiry Committee immediately.

The Court directed the AICTE to hold an inspection of the appellant college in May and submit a report to the court by June seven with regard to fulfillment of requirements. The appellant college was directed not to make any fresh admission for 2007-2008 without taking the permission of the court.

The court found considerable force in the submission made by the appellant college that the VTU had reallocated its students in colleges, which also had lapses, and that the students would be put through untold hardships if they were disturbed just prior to the examinations.
