Koli agrees to make confessional statement
New Delhi, Mar 1 (UNI) Nithari killings accused Surender Koli was produced from Central Jail, Tihar, before the court of Additional Chief Metropolitan Magistrate(ACMM) Kamini Lau here today for recording of statement under Section 164 of Criminal Procedure Code with his counsel G T Singh, Neeraj Agarwal and Aman Sarin.
Koli submitted in the court that he wanted to make a statement in the court and he had understood the consequences of making a statement and is also aware that he is not bound to make any statement.
The ACMM under the circumstances of the application of CBI for recording the confessional statement of Koli, marked it to the Metropolitan Magistrate Chandra Shekhar, New Delhi, however keeping in view the peculiar nature of the case and the gravity and sensitivity of the allegations involved .
The ACMM directed that in case if the Magistrate proceeds to record the statement, it would be appropriate in the interest of justice. The court also directed that the statement should be recorded in audio and video and should be free from all kinds of influences and pressure and Koli has been warned of the consequences of the same.
The court further directed that after the statement is recorded the copies of the recording shall be prepared in the presence of the Magistrate and Koli and the original copies of the same shall also be sealed in presence of the accused .
