SC to examine Delhi Master Plan 2021 tomorrow

New Delhi, Feb 11 (UNI) The Supreme Court will examine the recently notified Delhi Master Plan 2021 tomorrow, which seeks to provide relief to traders and paves the way for the development of the city.

A Bench comprising Justices Arijit Pasayat and S H Kapadia will also consider the petition filed by the Residents Welfare Association (RWA) challenging the validity of the new Master Plan.

The Plan, notified by the Delhi Government on February 7, proposes regularisation of about 1500 unauthorised colonies in the city besides permitting the height of buildings to 15 m instead of 11 m, which was permissible until now. It also permits commercial activities on 2183 roads of Delhi.

The RWAs have disapproved the plan and see it as contravening and nullifying the orders of this court. According to them, it seeks to please traders and builders' mafia in view of the forthcoming Municipal Corporation elections in Delhi.

Notably, the Supreme Court had last week stayed the sealing operations till February 12.

As per the orders of the Supreme Court, over 3 lakh traders protected by the two notifications, dated September 7 and 15, 2006, were supposed to file an affadivit by January 31 this year by way of an undertaking that they would stop the misuse immediately in case the two notifications were invalidated by the court. However, only 50,330 traders have filed such undertakings.

The Supreme Court will also consider the effect of non-filing of affidavits by the traders.
