CGHS cannot charge hefty transfer fee from new entrants: HC
New Delhi, Jan 29 (UNI) The Delhi High Court today held that the Cooperative Group Housing Societies (CGHS) can not charge hefty transfer fees from the new purchaser for allowing them to enter the society premises.
A bench of Chief Justice M K Sharma and Justice Hima Kohli said, ''The group housing societies could not have demanded or levied a hefty amount of Rs one lakh from the new entrants or purchasers.'' While deciding a bunch of petitions by new buyers against the Registrar Cooperative Societies(RCS), Delhi Development Authority(DDA), Shankar CGHS, Vavin CGHS etc, the Court said the business of the society was to construct flats and make allotment of the same to its members.
One of the other businesses of the society is to provide for and maintain the common facilities to all its members, it said.
The Counsel appearing for the RCS had submitted that the authorities had issued directives on December 14, 1999 and October 10, 2001 to all the CGHS not to charge any amount from the new members who were purchasing a flat.
