Professional colleges: Kerala moves SC challenging HC judgement

New Delhi, Jan 24 (UNI) Kerala today approached the Supreme Court challenging High Court's judgement striking down Kerala Professional Colleges or Institutions (prohibition of capitation fees, regulation of admissions, fixation of non-exploitative fee and other measures to ensure equity and excellence in professional education) Act 2006 as unconstitutional.

The state government in its appeal has contended that the impugned judgement on January 4 violates the law laid down by the apex court in Inamadar's case.

Kerala has also contended that it will give freehand to private unaided professional colleges to give admissions by charging heavy capitation fees at the cost of meritorious students which cannot be permitted.

The state also contended that malpractices being indulged in by these institutions cannot be allowed to continue and has prayed for the stay of the impugned High Court judgement till the final disposal of the appeal.
