No clash between Judiciary, executive: Paswan

New Delhi, Jan 11 (UNI) Lok Janshakti Party and Union Minister Ram Vilas Paswan today said there was no clash between judiciary and executive and 69 per cent reservation in Tamil Nadu should remain in the ninth schedule as it was not against the basic tenet of the Constitution.

Mr Paswan said this when asked whether the executive and judiciary were heading towards confrontation in view of the Supreme Court saying that issues placed under the ninth schedule were open to judicial reviews.

The LJP leader said there was no clash between the judiciary and the executive as was clear from the Apex Court verdict on MP's suspension over the cash-for-query scam.

Stating that he had not seen the details of the Court's verdict that issues in ninth schedule were open for judicial review, he said that as far as reservation was concerned, it was not against the basic tenets of the Constitution. So putting up 69 per cent reservation as in the case of Tamil Nadu under the ninth schedule was correct.

He said that the Constitution allowed reservation on the basis of social and economic backwardness but did not specify how much percentage be reserved. Only in the Mandal Commission case, the Apex Court had clarified that the reservation should not go beyond 50 per cent following which, on the request of the Tamil Nadu Government, its reservation policy of 69 per cent was put in the ninth schedule, he informed.
