HC denies relief to Nithari case accused

Allahabad, Jan 11 (UNI) The Allahabad High Court has refused to grant relief to both the main accused in the Nithari serial killing case -- Moninder Singh Pandher and his servant Surendra -- on the FIR lodged against them at police station sector 20 Noida.

The duo have come to the HC seeking quashing of the FIR and also commanding the police authorities not to take 'coercive measures' against them.

A division bench comprising Justices R C Deepak and B A Zaidi passed the order on a criminal writ petition filed by the duo.

The court has directed the state government to file its order within 10 days, whereby a CBI inquiry has been entrusted in the Nithari case.

During the course of hearing, father of a girl Deepika alias Payal alleged she had been kidnapped by the accused and the role of police is dubious.

According to him, FIR against both the accused was registered under section 363, 366 IPC at police station sector 20 Noida on the direction of the court passed under section 156 [3] of CrPC.

By the court order, the circle officer (CO) was investigating the case, but according to the complainant, the officer was not fair with the investigation. The court will hear the case on February 2.
