Petition in favour of suspension of MDMK functionaries
Chennai, Dec 27 (UNI) MDMK Headquarters Secretary and General Council Member N Ramamurthy today filed a petition in the Madras High Court seeking to withdraw the stay granted on the suspension of MDMK Presidium Chairman L Ganesan and Deputy General Secretary Gingee N Ramachandran from holding their party posts.
Justice P Jyothimani had passed an interim order on December 24, staying the operation of an MDMK resolution seeking to remove the two leaders from their posts on a petition filed by MDMK Saidapet Dvisional Secretary and General Council member T Sampath.
Mr Ramamurthy sought permission to implead himself as a party in that suit.
He said the suit was not maintainable as he was not aggrieved by the disciplinary action taken against Mr Ganesan and Mr Ramachandran.
There were nearly 1,500 members in the MDMK General Council and he could not represent the council in toto, Mr Ramamurthy contended.
As per MDMK rules and regulations, the General Secretary was vested with the power to take disciplinary action, including suspension, against any office bearer, he said.
As Mr Ganesan and Mr Ramachandran had indulged in anti-party activities, the action taken against them was valid in law, he said.
Mr Ramamurthy said all members of the MDMK high-level committee requested the General Secretary to expel Mr Ganesan and Mr Ramachandran from the party primary membership for their anti-party activities. However, the General Secretary did not expel them and only suspended them from their party posts, he added.
Meanwhile, Mr Ganesan and Mr Ramachandran filed a common suit seeking to declare null and void the meeting at Cumbum on December 23 and resolutions passed there to suspend, them from the posts.
