HC dismisses application to implead K'taka Minister
Bangalore, Dec 19 (UNI) The Karnataka High Court today dismissed an interlocutory application by former Education Minister H Vishwanath, seeking to implead PWD Minister H D Revanna as a respondent in his writ petition challenging the denotification of lands in Nagashettihalli and Bhoopasandra for setting up Mother Dairy unit.
The matter pertained to the setting up of Mother Dairy unit by the Karnataka Cooperative Milk Producers Ltd (KCMPL) and the alleged leasing of a part of the land to the Nandini Dairy Farmers Trust (NDFT). The petitioner had stated in his application that he had come to know that the Minister was the KCMPL Chairman and the Founder-Trustee of NDFT and he would be the beneficiary of the construction in the acquired land.
Chief Justice Cyriac Joseph and Mr Justice B S Patil observed that the KCMPL and NDFT were already in the array of parties and there was no material to indicate that Mr Revanna had personally benefited or interested in the acquisition of land or leasing of the land in favour of the Trust. Mere allegations would not be sufficient ground to implead him in his personal capacity, the court ruled, rejecting the application.
