Dalmiya to challenge legitimacy of expulsion

Kolkata, Dec 19 (UNI) Banished former BCCI president Jagmohan Dalmiya today vowed legal options claiming he was denied ''natural justice''.

Talking to the media after being expelled from the BCCI for life, Mr Dalmiya said ''I was hanged without a fair trial.'' He disclosed his written submission, including accounting explanations before the SGM(special general meeting) on Saturday, and also challenged the legality and validity of Clause 38(V) of the BCCI rules that provided for removal of the expelled person from the affiliated unit of the BCCI.

Mr Dalmiya stated that the disciplinary committee was 'biased', since all its members had expressed their views against him. He said since criminal proceedings were initiated against him on the same set of allegations, therefore the disciplinary committee could not run '' parallel proceedings on the same set of allegations.'' He finally stated that as per BCCI rules the process of adjudication should have been completed within six months and hence the issue was '' barred by limitations.'' Regarding the financial misappropriation that varied from Rs 21.74 lakhs to Rs 48 crores, was finally settled at Rs 8.98 crores as per the disciplinary committee for which he had given all explanations.

Mr Dalimya was banned for life in a special general body meeting of the BCCI in Jaipur for his alleged misappropriation of fund to the tune of Rs 42 crore in the BCCI. The resolution was passed to vote 29-2 by SGM and it held that Mr Dalmiya will not be able to hold any post, whatsoever, in any capacity either in the BCCI or any of its affiliated unit.

However, a contradiction arose as the CAB's constitution debars removal of its president midterm.
