HC seeks detail regarding tranfer of prisoner to hospital
Allahabad, Dec 14 (UNI) The Allahabad High Court today directed the District Judge, Basti to provide details regarding transfer of Ram Briksh Yadav from the Basti District Jail to hospital and thereafter to one trauma centre, Lucknow.
Ram Briksh Yadav -- a politician from Basti, was charged in the murder of a rival politician Mahatama Yadav during the Panchayat elections on August 25,2005, and taken in custody on November 10 last.
Bench comprising Justices Imtiayaz Murtaza and Amar Saran, directing that the prisoner be forthwith brought back to jail from the hospital, observing that transfer of prisoners from jail to hospital soon after his entry to jail without sanction from the Inspector General (prisons) and a certificate of the civil surgeon that the prisoner could not be effectively treated in the jail hospital or needed surgery which could not be performed in jail was a violation of paragraph 1058 of the Jail Manual.
The Court directed the IG (prison) to stop nefarious practice. It further directed the District Judge, Basti to enquire how the prisoner had cut a 101 kg cake in jail for celebrating the birthday of Chief Minister Mulayam Singh Yadav on November 22, 2006, as was reported in some newspapers.
The District Magistrate, Basti had already set up an inquiry into this incident. The Court has also asked the report to be placed before it on the next hearing on February 5, 2007.
The Court directed the IG and security to be present in Court on the next date to explain why the prisoner's name was omitted from the list of persons, who were given gunners by the state government.
The Bench further directed the trial court to expedite framing of the charges and conduct the trial of the prisoner on a day to day basis in accordance with section 309 of CRPC.
