HC rejects petition regarding Haj House
Allahabad, Dec 8 (UNI) The Allahabad High Court today dismissed a writ petition, seeking prohibition of the construction of a 'Haj House' at the bank of river Hindon, near the national highway Pargana Loan tehsil in Ghaziabad.
Dismissing the writ petition on the grounds of 'locus standi', a division Bench comprising Justices Amitav Lala and Sajay Mishra observed that the Haj House is nothing but an assembling centre for the pilgrims of different areas from where they will proceed to board ships or catch flights.
The Court passed this order on the writ petition filed by Mahanagar Ghaziabad's Chetana Manch and others, saying that ''we do not find any reason to withhold the persons concerned from making haj house in a particular place where it is proposed or partially constructed, while acquiring land by an appropriate committee for the construction of Haj House is perfectly within the four corners of law.'' The state government has leased out a land to the UP Haj Samiti for a period of 30 years in November 2004 on banks of river Hindon in Ghaziabad.
The Haj Samiti had taken permission in February 2005 for the construction of Haj House. On March 30, 2005 -- Chief Minister Mulayam Singh Yadav had laid down the foundation stone of the Haj House.
