Court rejects ABA plea of owner of KR Construction

Mumbai, Dec 8 (UNI) The sessions court today rejected the anticipatory bail plea of owner of K R constructions and four others, apprehending arrest in connection with a case of Sodomy registered against them at the Malad police station in north-west Mumbai.

Additional Sessions Judge M L Tahilyani rejected their plea on the grounds that investigation in the case is under progress and hence no interim relief could be granted.

Prosecution argued that investigation in the case was in progress and their custody is required to complete the investigation.

However, the defence counsel said the applicants had nothing to do with the alleged offence registered against them and the complainant have taken revenge in his removal from the job as he had manipulated the accounts and siphoned off the payments to workers.

Jayantilal Purohit, a site supervisor with Borivali based K R construction, in his complaint, said on November 20, he was called to the residence of Rajendra Shah Batlar of KR construction.

Then he was taken to a godown by Shah and others where they forced him to sign statements showing siphoning off the payments meant for workers. After that they sodomised him, burning his private parts with agarbati and cigarettes.

He was freed from the godown at O300 hours on November 21 and threatened with dire consequences if he reported the matter to anyone.

He left Mumbai the next day for Rajasthan, his home state, but returned back on November 27 at the instance of his relatives here.

He had been taken to a hospital where he was medically examined about the torture. He then filed a police complaint agaist the five people on November 28 in this regard.

The Court rejected the anticipatory bail pleas of Rajendra Shah Raju Batlar, Sandeep K Shah, Ranjeet R Chavan, Lalit Khandelwal and Kansing Deora.
