BJP for accomodating creamy layers in ''unoccupied quota''
New Delhi, Dec 8 (UNI) The Bharatiya Janata Party today said it was in favour of providing the creamy layer reservation benefits within 50 per cent quota allowed by the Supreme Court.
Expressing the party's view points on the contentious reservation issue, BJP Parliamentary Party spokesperson Vijay Kumar Malhotra said the Government data had showed that many of the posts reserved for the Scheduled Castes, Scheduled Tribes and Backward Classes were not filled up.
The creamy layers should be allowed to occupy this ''unoccupied'' quota, he said adding priority should be accorded to the sections who had never availed the benefits.
He said the Standing Committee of Parliament had given its recommendations on the SC, ST, OBC and Most Backward Castes but the Government had rejected them.
The party can not say anything on the issue until it went through the contents of the Bill. However, the party would prefer that the Bill go back the Standing Committee for detailed consideratation, he said.
On the powers and functioning of the Judiciary, Legislature and the Executive, Mr Malhotra said the party accepts that the Judiciary has powers to review the laws passed by Parliament and the State Legislatures and set right the anamolies. The Prime Minister should convene an all party meeting on the issue, he added.
He, however, said the Judiciary should not encroach upon the powers of the Executive by appointing Court's own ''Monitoring Committees.'' If the Executive failed to implement the Court's orders, they should proceed with contempt proceedings.
