SC quashes Central notification of IMDT Act
New Delhi, Dec 5 (UNI) The Supreme Court today quashed a Central notification applying the provisions of the Illegal Migrants Determination by Tribunals Act (since held illegal) to tribunals under the Foreigners Act for detecting illegal Bangladeshi migrants in Asom.
The notification issued in the wake of apex court's verdict dated July 12, 2005 quashing the IMDT Act also put the onus on the complainant to prove that a particular person was Bangladeshi under the Foreigners Act.
The court order was passed by a Bench of Justices B Sinha and P K Balasubramanyan.
The order came on writ petitions challenging the notification on the grounds that its provisions were akin to the IMDT Act.
