Maneka Gandhi's application to come up before HC tomorrow
Mumbai, Dec 4 (UNI) The Bombay High Court will hear tomorrow the appeal filed by Lok Sabha Member and animal rights activist Maneka Gandhi pleading for quashing proceedings of defamation against her in a Metropolitan Court here.
The case which come up for hearing before Justice Abhay Oka, pertains to an article written by Ms Gandhi, in an eveninger here on January 6, 2005, criticising use of pesticides, insecticides and outlining its dangers.
The complainant, Prithpal Pruthi, President of Crop Care Foundation of India (Pesticides Association of India) has alleged that the article was written with a malafide intention to defame their federation. The article was also published worldwide in an internet edition.
Pruthi alleged that the article contains false, baseless and incorrect statements about the pesticides, in which the federation members deal. She should have verified the facts and provided scientific evidence that pesticides cause cancer and other health related problems.
However, Ms Gandhi submitted in her application that it is her duty to alert the public at large of the problems that can be caused by chemicals, pesticides and insecticides. She has provided a list of the studies around the world that highlight the dangers of pesticides and its effects. She fears that the complaint has been filed to pressurize her from writing articles on the harmful effects of the pesticides.
She said she has not named any federation or person and therefore there is no intention of defaming anyone and sought quashing of the process against her in the local court.
