SC dismisses PIL seeking stop on Chinese FDI

New Delhi, Dec 1 (UNI) The Supreme Court today dismissed a PIL seeking directions to the union government not to allow Foreign Direct Investment (FDI) from China as such a step may increase threat to national security.

A bench comprising Justices K G Balakrishnan and D K Jain refused to entertain the petition filed by Rasiklal Shantilal Mardia on the grounds that it was a policy decision of the government and this court cannot interfere with a policy decision.

Earlier the petitioner who appeared in person contended that that the government was acting against the advice of National Security Council according to which rules for issuing visa to the Chinese should not be relaxed to facilitate the so-called 'direct investment' from that country.

The petitioner also forcefully contended that since the issue of national security and integrity was involved, this court should consider the matter which was of paramount interest for the country.

The court, however, made it clear that since the government is aware of all these facts, this court cannot lay down the foreign policy of the country and it is for the government to decide.
