Vikas Yadav withdraws petition from Apex Court

New Delhi, Dec 1: Vikas Yadav, the main accused in the Nitish Katara murder case today withdrew his petition filed in the Supreme Court in view of the latest developments in the trial of the case.

A bench comprising Justices K G Balalkrishnan and D K Jain told the counsel for the petitioner that the present petition has become infructuous in view of the fact that Bharti Yadav, the key prosecution witness in the case, has already been examined by the trial court and her evidence is over.

The main ground raised by Vikas Yadav in his appeal against the Delhi High Court order dismissing his bail application, was that he had been in jail for about four-and-a-half-years and it will take long before all the witnesses in the case are examined.

Earlier, the state has been opposing his bail application on the grounds that his sister Bharti Yadav would not be able to depose freely without fear if Vikas, son of former Rajya Sabha member, D P Yadav, is released on bail.

Counsel for Vikas also contended that since his cousin Vishal Yadav has already been granted bail why he should be denied the same.

The court reminded the petitioner that the petition for the cancellation of Vishal Yadav's bail was pending in the apex court.

The court dismissed as withdrawn the petition of Vikas Yadav after his counsel sought permission to withdraw his petition as he wanted to appproach the High Court again.
