Transfer of case petition moved to SC by Satish Jaggi

New Delhi, Nov 28 (UNI) A petition seeking transfer of case from the Sessions Court Judge Sanman Singh, Raipur, Chhattisgarh has been moved to Supreme Court by Satish Jaggi, son of Avtar Singh Jaggi, an NCP leader in whose murder case Amit Jogi, son of former Chhattisgarh Chief Minister Ajit Jogi is the main accused.

The petitioner has sought transfer of the case from the court of the Sessions Judge as the judge is the elder brother of sitting Congress MLA Gulab Singh and hence the petitioner has bonafide and genuine apprehensions that they will not get justice if the case is not transferred to some other court.

Avtar Singh Jaggi was shot at on June 4, 2003 and succumbed to injuries the next day.

Ajit Jogi was the state Chief Minister at that time.

The investigation was transferred to CBI and Amit Jogi and others were arrested by the CBI in 2005.

High court granted him bail in May 2006.

According to the petitoner, Renuka Jogi, wife of Amit Jogi is contesting Assembly by-elections in Chhattisgarh and the apprehension of the petitioner is that the trial will be concluded before the polling takes place in the by-elections and he may be given clean chit as Amit Jogi has all of a sudden dropped all the defence witnesses after the transfer of the case to the court of Sanman Singh, Sessions judge.

The petition will be heard tomorrow for getting it listed for immediate hearing so that the proceedings in the trial court may be stayed till the disposal of the special leave petition challenging the Chhattisgarh High Court judgement through which the petition of Satish Jaggi seeking transfer of the case was dismissed.
