Prof's case: next hearing on Dec 6

Ujjain, MP, Nov 22 (UNI) A local court today quashed an appeal filed by Mr Himanshu Sabharwal, son of late Professor H S Sabharwal, as discussing the matter in lower court was not appropriate when it pending in higher court.

Prof Sabharwal, a faculty of Madhav College, had died in student violence over the postponement of student union election on August 26.

After the Madhya Pradesh Government ordered CID inquiry into the case, ABVP workers Shashiranjan Akela, Vimal Tomar, Vishal Rajoria, Hemanth Dubey and Sudhir Yadav were arrested.

Framing of charges against the accused was scheduled to take place in the court of District Sessions Judge A K Sharma.

However, Mr Himanshu's counsel requested the court to dispose the appeal filed under section 173(8) of the IPC before framing the charges.

The court acceded the request, heard arguments from both sides and ruled that discussion on the matter in this court was not appropriate as it was also pending in the Supreme Court.

The court fixed December 6 as the next date for hearing in the case.

Mr Himanshu's demand for his father's scooter, which was seized by police, was rejected in order to show the scooter to witnesses.
