HC directive to Police Commissioner Roy

Mumbai, Nov 17 (UNI) The Bombay High Court has directed Police Commissioner A N Roy to file his affidavit by Monday in a case where alleged Chhota Rajan aide Ramnarayan alias Lakhan Gupta was killed in a police encounter on November 11.

A division bench comprising Justices S B Mhase and S R Sathe rejected the plea of petitioner Ramprasad Gupta, the younger brother of the deceased, for a second postmortem while the first report stated that five marks of injuries were found on his body (bullet marks). It was alleged by the petitioner that it was a clear case of cold-blooded murder by police.

Advocate Shyam Marvadi, on behalf of the petitioner, submitted that Lakhan Bhaiyaa along with his friend Anil Bheda, had been picked up by the police hours before the encounter In fact, the petitioner had sent telegrams and faxes to the Superior police authority and Deputy Chief Minister R R Patil an hour after they were picked up, informing them about the incident.

However, Chief Public Prosecutor Satish Borulkar submitted that the police had trapped Lakhan Bhaiyaa after they received a tip-off that he had come to meet one of his informers near Nana Nani Park at Versova, Andheri.

When the police asked him to surrender, Lakhan Bhaiyaa fired two shots at them and in retaliation, police shot back leading to his death.

According to the petitioner, Ramnarayan was earning his living by way of working as a estate agent in Vashi and had no connection with Chota Rajan.

The case will come up for further hearing on November 20.
