HC appoints mediator between BHA committee and its two member
Mumbai, Nov 14 (UNI) The Bombay High Court today appointed senior counsel Rafiq Dada as the mediator for the two hockey players and the Bombay Hockey Association(BHA) to sort out the issues between them.
A division bench comprising Justices F I Rebeillo and Anup Mohta held that Counsel Rafiq Dada will mediate on the issues regarding suspension of the two members from the management committee of the association was ''legal, valid or proper''. Also, whether the two would continue to be members of the executive committee till the end of the it's term.
The Counsel has been directed to file his report in the matter within four weeks.
The petitioners --Joaquim Carvalho and Avitus D'cruz --had played hockey for the Indian team during the Olympics in 1984. Both were suspended from the management committee of BHA for complaining to the Registrar of Companies that the association has not been having regular meetings as subscribed by the Companies Act, 1956.
Following the complaint, the RoC issued notice to BHA. The BHA held that the act of both the members was against the rules of the association and hense suspended them.
The two approached the HC challenging their suspension.
